Terms of Sale and Subscription

1. Seller and scope

These terms govern purchases of Cloudata software subscriptions and digital technology services sold by CLOUDATA SOLUTIONS E.I.R.L. ("Cloudata"), a company established in Peru. They supplement the product-specific terms and privacy notice shown before purchase.

2. Products, eligibility, and account information

The product page identifies the included features, compatible browsers, usage limits, subscription interval, currency, and price. Customers must provide accurate contact and billing information and be legally able to enter this agreement. Business buyers confirm they are authorized to act for the named organization.

3. Purchase process

1. Select a monthly or annual plan from the product page.
2. Review the plan, country-based currency, recurring price, trial, and tax information.
3. Provide billing information and accept these terms, the privacy notice, and refund policy.
4. Enter card data directly in Culqi's secure checkout and confirm payment.
5. Receive an order reference and license key after Culqi confirms the subscription.

No full card number, security code, or card expiration date is received or stored by Cloudata.

4. Prices, currency, and taxes

Customers billed in Peru pay the displayed PEN price, which includes applicable Peruvian IGV when stated at checkout. Customers in other countries pay the displayed USD price. Any amount, currency, included tax, trial, and recurring interval are shown before authorization. The customer's bank may apply currency conversion or international transaction charges. Business customers remain responsible for taxes they must self-assess in their jurisdiction.

5. Trial, renewal, and payment

When a trial is displayed at checkout, the first recurring subscription charge is scheduled after that trial. Culqi may place and reverse a small temporary authorization to verify the card; this is not the subscription charge. Unless canceled, monthly subscriptions renew each month and annual subscriptions renew each year using the authorized payment method. Failed payments may place access into a limited retry period or suspend Pro features. Cloudata will not change a recurring price without advance notice and any consent required by law.

6. License and acceptable use

A paid subscription grants one named user a limited, non-exclusive, non-transferable right to use the applicable Pro features during the active period. The customer may not resell a key, bypass license limits, reverse engineer protected service components, use the product unlawfully, or interfere with service security. Content created by the customer remains the customer's responsibility.

7. Cancellation and refunds

Future renewals can be canceled at the billing page or through support. Cancellation during a trial prevents the first recurring charge. Cancellation after payment normally leaves access active until the end of the current period. Refund eligibility and processing are described in the Refund and Cancellation Policy. Mandatory consumer rights always prevail.

8. Availability, support, and changes

Cloudata uses reasonable care to provide secure, functional software but does not promise uninterrupted operation on every third-party website or browser version. Support is available through help@cloudata.pe. Material product or term changes will be communicated reasonably in advance; changes do not retroactively reduce an already paid period.

9. Intellectual property and confidentiality

Cloudata and its licensors retain all rights in the software, brands, documentation, and service design. Each party must protect confidential information received in a business engagement and may use it only for the agreed service, except where disclosure is required by law.

10. Liability

To the extent permitted by law, neither party is liable for indirect or consequential losses that were not reasonably foreseeable. Cloudata's aggregate contractual liability is limited to amounts paid for the affected service during the preceding twelve months. These limits do not apply where exclusion is prohibited, including fraud, willful misconduct, or mandatory consumer liability.

11. Law and disputes

These terms are governed by the laws of Peru. Consumers retain non-waivable protections and dispute forums available in their country of residence. Before formal proceedings, contact help@cloudata.pe so the parties can seek a documented resolution. Consumers in Peru may also use the Libro de Reclamaciones and competent consumer authorities.

Cloudata Solutions E.I.R.L. vende suscripciones digitales desde Perú. Antes del pago se muestran producto, moneda, precio recurrente, impuestos y prueba aplicable. Culqi procesa la tarjeta; Cloudata no recibe los datos completos de la tarjeta. La suscripción se renueva hasta su cancelación. Los derechos obligatorios del consumidor prevalecen y los consumidores peruanos pueden usar nuestro Libro de Reclamaciones.
